If one has a relative working in Saudi Arabia, suppose he had unnatural death, then according to Saudi Islamic law (Read the section named 'Settlement of Death Compensation Claims' and 5th point in this section; at the end of this post, this section will be presented i.e. pasted.), blood money (Diyya) should be paid to the the family of the victim by the culprit and the amount to be paid depends on the religion and gender of the victim. This amount of the blood money prescribed for a Non Muslim is less than that is prescribed for a Muslim.
If the victim is a Muslim, then the amount to be paid is SR1,00,000/-, for a Christian or a Jew, it is SR50,000/- and if the victim is Hindu it is about SR6,666.66/-.
What is Saudi Arabia? A radical Islamic country? Well ignorant columnists under the influence of feigning Islamists say this in news papers. It is the birth place of Mohammad and Islam. Koran and Sunna are its constitution. Muslims feel it is a perfect example as a country for Muslims. Thinking of Saudi Arabia as a radical Islamic country can only be termed as puerile and it is testimony to ones ignorance of Islam itself.
Lets see what Koran has to say on this 'Muslims and Non Muslims are not equal'.
- Allah is the guardian of those who believe. He brings them out of the darkness into the light; and (as to) those who disbelieve, their guardians are Shaitans who take them out of the light into the darkness; they are the inmates of the fire, in it they shall abide.(002:257 SHAKIR)
- Not equal are the Companions of the Fire and the Companions of the Garden: it is the Companions of the Garden that will achieve Felicity. (Note: Only in Yusuf Ali translation, you find this 'felicity' which means satisfaction but in all other translations you find words like victory, success and triumph. Here the companions of fire means non Muslims who just by rejecting Islam go to Hell and burn there for eternity.) (059.020 YUSUF ALI)
- Say: "Who is the Lord and Sustainer of the heavens and the earth?" Say: "(It is) Allah." Say: "Do ye then take (for worship) protectors other than Him, such as have no power either for good or for harm to themselves?" Say: "Are the blind equal with those who see? Or the depths of darkness equal with light?" Or do they assign to Allah partners who have created (anything) as He has created, so that the creation seemed to them similar? Say: "Allah is the Creator of all things: He is the One, the Supreme and Irresistible." (013.016, YUSUF ALI)
- What! Do those who seek after evil ways think that We shall hold them equal with those who believe and do righteous deeds,- that equal will be their life and their death? Ill is the judgment that they make. (045.021, YUSUF ALI)
- Is then the man who believes no better than the man who is rebellious and wicked? Not equal are they. (032:018, YUSUF ALI)
- Not equal are the blind and those who (clearly) see: Nor are (equal) those who believe and work deeds of righteousness, and those who do evil. Little do ye learn by admonition! (040.058, YUSUF ALI)
- Shall We treat those who believe and work deeds of righteousness, the same as those who do mischief on earth? Shall We treat those who guard against evil, the same as those who turn aside from the right? (038.028 YUSUF ALI)
- We have sent down to thee Manifest Signs (ayat); and none reject them but those who are perverse.(002:099 YUSUF ALI)
- Is one who worships devoutly during the hour of the night prostrating himself or standing (in adoration), who takes heed of the Hereafter, and who places his hope in the Mercy of his Lord - (like one who does not)? Say: "Are those equal, those who know and those who do not know? It is those who are endued with understanding that receive admonition. (039.009, YUSUF ALI)
- If anyone invokes, besides Allah, Any other god, he has no authority therefor; and his reckoning will be only with his Lord! and verily the Unbelievers will fail to win through! (023:117, YUSUF ALI)
- O ye who believe! Spend out of (the bounties) We have provided for you, before the Day comes when no bargaining (Will avail), nor friendship nor intercession. Those who reject Faith they are the wrong-doers. (002:254, YUSUF ALI)
- Is the man who follows the good pleasure of Allah Like the man who draws on himself the wrath of Allah, and whose abode is in Hell?- A woeful refuge! (003:162, YUSUF ALI)
- Those who resist Allah and His Messenger will be among those most humiliated. (058.020 YUSUF ALI)
- Fight those who believe not in Allah nor the Last Day, nor hold that forbidden which hath been forbidden by Allah and His Messenger, nor acknowledge the religion of Truth, (even if they are) of the People of the Book, until they pay the Jizya with willing submission, and feel themselves subdued. (009.029, YUSUF ALI)
- And (many) faces on that day, on them shall be dust,Darkness shall cover them.These are they who are unbelievers, the wicked. (Shakir, 80:40-42)
- We have indeed created man in the best of moulds, Then do We abase him (to be) the lowest of the low,- Except such as believe and do righteous deeds (i.e. Except Muslims.): For they shall have a reward (YUSUF ALI, 95:04-06)
- As to those who disbelieved: What! were not My communications recited to you? But you were proud and you were a guilty people. (Shakir, 45:31)
- These are the portents of Allah which We recite unto thee (Muhammad) with truth. Then in what fact, after Allah and His portents, will they believe? Woe unto each sinful liar,(Pickthall, 45:06-07)
Regarding equality, one needs to ask in what respects and in what sense Muslims and Kafirs are not equal. The dictionary meaning of the word ‘equal’ is same privileges, same status and same rights to all in a group. Here Koran says Muslims are not equal to Kafirs in the eyes of Allah, in Knowledge, in life and death and finally in the laws of Islam.
Here the word Knowledge (read the significance of using capital word) means the message sent by Allah to mankind as guidance so to bring them closer to him. This message and knowledge is contained in Koran and pertains to obeying what Allah ordered and staying away from what he forbade.
Here ‘not equal in death’ refers to Muslims going to paradise and Kafirs going to hell where they burn in fire for eternity and ‘Not equal in life’ refers to Kafirs being humiliated at the hands of Muslims by Allah as in the verse 59:20.
And finally ‘not equal in the Islamic law’ refers to verse 9:29 and this says Non Muslims have to pay Jizya and have to be made to feel humiliated, thus Muslims and Kafirs are not equal. Is there any Muslim who says, after reading this, Islam can co-exist with others and is tolerant towards others?
And if Allah says that by mere disbelief in Islam is enough to send some one to Hell, then those going to Heaven and Paradise (Muslims) must have some special attributes in the eyes of Allah. The following two verses are proof for that. The following two verses also explain compulsion and desire of Muslims to convert others in to Islam:
- Thus, have We made of you an Ummat justly balanced, that ye might be witnesses over the nations, and the Messenger a witness over yourselves; and We appointed the Qibla to which thou wast used, only to test those who followed the Messenger from those who would turn on their heels (From the Faith). Indeed it was (A change) momentous, except to those guided by Allah. And never would Allah Make your faith of no effect. For Allah is to all people Most surely full of kindness, Most Merciful.(002.143 YUSUF ALI)
- Ye are the best of peoples, evolved for mankind, enjoining what is right, forbidding what is wrong, and believing in Allah. If only the People of the Book had faith, it were best for them: among them are some who have faith, but most of them are perverted transgressors. (003.110, YUSUF ALI)
“That ye might be witnesses over the nations, and the Messenger a witness over yourselves;”;
“What this sentence in the verse means is that when the whole of mankind is called to account, on the day of Judgment, the Prophet, as God's representative, will stand witness to the fact that he had communicated to the Muslims and had put into practice the teachings postulating sound beliefs, righteous conduct and a balanced system of life which he had received from on high. The Muslims, acting on behalf of the Prophet after his return to the mercy of God (meaning Prophet’s death), will be asked to bear the same witness before the rest of mankind and to say that they had spared no effort in either communicating to mankind what the Prophet had communicated to them, or in exemplifying in their own lives what the Prophet had, by his own conduct, translated into actual practice.”
“This position of standing witness before all mankind on behalf of God, which has been conferred on this community, amounts to its being invested with the leadership of all mankind. This is at once a great honor and a heavy responsibility.” (Maududi is saying that Muslims are the chosen ones by Allah, hence they are superior.)
“Furthermore, just as the Prophet had been entrusted with the heavy responsibility of conveying to the Muslims the guidance which he had received, in a like manner a heavy responsibility has been laid on the Muslims to communicate this guidance to all mankind.”
“If the Muslims fail to establish before God that they did their duty in conveying to mankind the guidance they had received through the Prophet they will be taken to task seriously and their honourable position as the leaders of the whole world, far from being of any help to them, will spell their disaster.”In Islamic belief, these two verses are telling Muslims that not only they should proselytize but they should succeed in establishing Allah’s law (Sharia law) as supreme law on the earth like Mohammad succeeded in converting all to Islam in Saudi Arabia and establishing Islamic law there. Here violence is not mentioned directly but by mentioning Prophet as example one can infer that violence or any other means, for realizing this goal of establishing Allah’s law as supreme law, are perfectly allowed.
Lets see a ahadith which tells a bit about verse 3:110 and its significance. It perfectly agrees with Maududi's explanation on this verse and all classical commentaries on Koran.
Volume 6, Book 60, Number 80, (Sahih Bukhari)
Narrated Abu Huraira:
The Verse:--"You (true Muslims) are the best of peoples ever raised up for mankind." means, the best of peoples for the people, as you bring them with chains on their necks till they embrace Islam.
In the beginning we have seen inequality of Muslims and Non Muslims in Saudi law and then in Koran. Here again we can see ahadith confirming this inequality in Islam.
Volume 4, Book 52, Number 283: (Sahih Bukhari)
Narrated Abu Juhaifa:
I asked Ali, "Do you have the knowledge of any Divine Inspiration besides what is in Allah's Book?" 'Ali replied, "No, by Him Who splits the grain of corn and creates the soul. I don't think we have such knowledge, but we have the ability of understanding which Allah may endow a person with, so that he may understand the Qur'an, and we have what is written in this paper as well." I asked, "What is written in this paper?" Hereplied, "(The regulations of) blood-money, the freeing of captives, and the judgment that no Muslim shouldbekilled for killing an infidel."
If we combine this ahadith with the verses 2:178, 4: 092 (A Muslim must not kill a Muslim intentionally) and 4:093, we get the present day Islamic law that says A Muslims's life can be taken only in three cases 1. When Muslim kills a Muslim intentionally, 2. When a Married Muslim commits adultery and 3. When a Muslim leaves Islam to other faith. In essence, in Islam punishment for killing a Muslim and a Non Muslim is not same. However one look at this, this is the ultimate and worst devaluation of Kafirs; discrimination can not get worse than this.
Other than this, in sharia law, there are many more laws (provisions) that discriminate against Non Muslim by imposing humiliating conditions, called tolerance by Muslims, and yet their apologists boast about equality and justice in Islamic Law, but a casual look here showed that Islamic Law is indeed a discriminatory and imperialist.
Note: Saudi Law:
SETTLEMENT OF DEATH COMPENSATION CLAIMS
1. Admissibility :
The Death Compensation (Blood Money or Diyya) is admissible in cases of unnatural deaths only such as road/ traffic/ industrial/fire accidents, murder, etc. provided the responsibility or a part of it, is fixed by the Saudi authorities concerned on a causer i.e. a person other than the deceased Indian national and that the person thus held responsible is in a position to pay the Death Compensation according to the provisions of the Shariat Law.
2. Inadmissibility of Death Compensation in some cases :
Death Compensation is not admissible in the following cases of unnatural deaths:
Suicide cases;
Deceased held fully responsible for his accidental death. (In many cases, deceased is held responsible, in part, which accordingly reduces the compensation amount.);
Death of the causer at the same time in case of an accident;
Untraceability of the causer, especially in a hit and run accident;
Untraceability of camel owner(s) where traffic accidents are attributed to sudden arrival of camels on the roads;
Fixing of responsibility on the causer is waived due to technical reasons or mechanical failure of vehicle;
Lightning, dust-storms, etc. which are treated as acts of God; and
Agricultural workers are not entitled to compensation in an industrial accident.
3. Volume of work .
Around 70% of the total deaths registered in the Missions are unnatural. Both, the Embassy & the Consulate handle settlement of Legal Dues and Death Compensation in their respective areas of jurisdiction. However, final records are maintained in the Embassy and almost all enquiries relating to settlement of Legal Dues/Death Compensation are received in the Embassy only.
4. Mode of Pavment :
All Death Compensation cases (except industrial accidents) in Saudi Arabia are settled through concerned Shariat Courts in accordance with the Shariat Law.
5. Maximum Amount admissible :
The maximum amount of Death Compensation (Diyya) generally admissible in Saudi Arabia, in respect of road/traffic/fire accident, murder, etc. is as under:
Death Compensation in respect of a male person:
i. Muslim - SR. 100,000/-
ii. Christian/Jew - SR.50,000/-
iii. Other religions : such as Hindu, Buddhist, Jain, etc. - SR 6666.66
In the case of death of a female, death compensation allowed is equal to half the amount as admissible to males professing the same religion. Further the amount of compensation admissible, is based on the percentage of responsibility fixed on the causer e.g. if the causer is held 50% responsible for the accident resulting in the death of a Muslim, the amount of Death Compensation admissible will be SR 50,000 only.
